General Terms and Conditions of Sale
Definitions
- Account: profile of the Registered Customer, containing their personal information and allowing them to perform a range of operations related to Orders, such as, by way of example and not limited to: monitoring Orders, cancelling Orders, making withdrawals and returns, requesting information. The Account is strictly personal and is protected by a username and password;
- BasicCard: virtual shopping card that may be subscribed to by the Customer in order to obtain discounts and promotional offers;
- Registered Customer: Customer who has created an Account by completing a set of information, including first name, last name, date of birth and email address;
- Guest Customer: any natural person acting for purposes not related to any commercial, entrepreneurial or professional activity possibly carried out, who intends to purchase the products offered for sale on Superga.com;
- Customer: Registered Customer and Guest Customer;
- General Conditions: this document, containing the conditions of sale of the Products, which the Customer accepts by selecting the appropriate checkbox;
- Superga: Superga S.r.l., VAT number 12685420015, with registered office in Largo Maurizio Vitale, no. 1, Turin, 10152, Italy, the selling company with which the Customer enters into the General Conditions;
- Trademarks: all registered and/or de facto trademarks present on the Products, in commercial communications and on the platform owned by Superga, including, by way of example and not limited to: Superga;
- Order(s): the purchase of Products made by the Customer on the Platform.
- Parties: Superga and the Customer, when jointly referred to;
- Platform: online commercial platform related to Superga, available at the domain www.superga.com;
- Product(s): any item purchased on the Platform;
1. Subject Matter
1.1 The General Conditions govern the relationship between Superga and the Customer with reference to the Products and, more generally, to the use of the Platform.
2. Applicability of the General Conditions
2.1 The General Conditions apply to each and every individual order placed on the Platform by a Customer who qualifies as a consumer pursuant to Article 2, letter (e), of the Consumer Code, and become effective upon completion of the purchase procedure on the Platform, by ticking the appropriate “I accept” checkbox.
2.2 The Customer declares that they have read all the information provided during the purchase procedure, that they are of legal age and/or have legal capacity, and that they fully accept the General Conditions.
3. Offer for Sale of Products and Submission of the Order
3.1 The Products are offered for sale on the Platform, with a specific description of their characteristics and an indication of the unit price.
3.2 Superga ensures that the images accompanying the Product descriptions accurately represent the Products as closely as possible. However, also due to the browser and monitor used to access the Site, certain characteristics such as colour and size may differ.
3.3 The prices of the Products indicated on the Platform are inclusive of taxes and VAT as applicable by law and exclude shipping costs.
3.4 Shipping costs are calculated at the Order summary stage, taking into account applicable rates, the destination country, the value of the Order, and any promotions in effect at that time. By way of example and not limitation, shipping may be free once a certain purchase value has been exceeded (clearly indicated on the Platform), or subject to specific discounts, or higher shipping costs may apply if the delivery address is outside Italy. In any case, the Customer will be informed of the total cost before confirming the Order.
3.5 The Customer, under their sole responsibility and according to their needs, selects the Products included in their Order, ensuring that they verify the type of item chosen, colour, and size, and completes the procedure by following the Platform’s rules and procedures.
3.6 Product prices may be subject to change until the Order is completed. In any case, before confirming the Order, the Customer is invited to verify the final sale price, which will be summarized at the end of the purchase process.
3.7 The Order is deemed completed when it is confirmed by Superga through a communication sent to the email address provided by the Customer, following the successful completion of the payment procedure.
3.8 If, after sending the confirmation communication referred to above, Superga finds that one or more Products included in the Order are unavailable or cannot be shipped, it will inform the Customer as soon as possible and refund the price of the unavailable Products, while the Order shall remain valid and binding for any confirmed Products.
3.9 The Customer may not modify the Order once the purchase procedure on the Platform has been completed.
3.10 However, the Customer may cancel the Order before it has been processed, by following these procedures:
In the case of a Registered Customer, by accessing the “Orders” section, selecting “Details” for the Order to be cancelled, and clicking the “CANCEL ORDER” button;
In the case of a Guest Customer, by clicking the “CANCEL ORDER” button at the bottom of the page that opens via the “view my order” link contained in the Order confirmation email.
3.11 If the Order has already been processed and therefore the “CANCEL ORDER” button does not appear or is not selectable, the Customer may refuse delivery of the Order, completing the procedure with the courier, or activate the withdrawal and/or return procedure referred to in Article 7 of the General Conditions.
3.12 If the Order is cancelled within the terms set out above, the Customer will receive a refund of the amount paid at the time the Order was completed.
4. Payment Terms
4.1 Payment for the Products may be made exclusively by credit or debit card (American Express, Visa, Mastercard), or via Apple Pay (available only on Mac, iPhone, and iPad devices), PayPal, and Satispay. It is also possible to use instalment payment methods (or deferred payments) provided by PayPal, Klarna, and Scalapay. If the Customer chooses to use instalment payment services offered by third-party providers, they accept the relevant terms and conditions of such providers and expressly release Superga from any liability arising from the use of these payment services, also acknowledging that they must contact the relevant providers directly should they require assistance.
4.2 Orders are processed in € (euro), £ (pound sterling), ¥ (yen), and $ (US dollar).
4.3 At no stage of the payment process will Superga have access to the Customer’s card details. The Customer will be redirected to a secure site, and card data will be transmitted directly to Shopify International Ltd. (an Irish company), which processes payments on behalf of Superga. The transmitted data will be sent securely through encrypted data transfer. The site’s security system is based on a TCP/IP protocol with 128-bit encryption, certified by VeriSign.
4.4 Under no circumstances shall Superga be held liable for any fraudulent or improper use of credit cards by third parties during the payment process.
5. Shipping
5.1 Orders may be shipped to all countries of the European Union and the Principality of Monaco. Withdrawal and/or return requests may be submitted from the same countries. Delivery to so-called “duty free” areas is expressly excluded, including, by way of example and not limitation, Livigno, Campione d’Italia, the Channel Islands, Gibraltar, the Canary Islands, and the Vatican City.
5.2 The purchased Products will be delivered to the address indicated by the Customer in the Order within the timeframe specified in the Order itself, by Superga and its logistics service providers, at the cost specifically indicated on the Platform before the Order is submitted.
5.3 Delivery methods and timeframes are indicated on a case-by-case basis at the conclusion of each Order, also depending on the shipping options made available on the Platform and selected by the Customer.
5.4 Delivery times indicated on the Platform are to be considered indicative. Superga undertakes to use its best efforts to comply with them and, in any case, to deliver within a maximum period of 30 (thirty) days from the day following the completion of the Order. Any delay, or any delivery of Products from the same Order carried out through multiple partial shipments, will be promptly communicated to the Customer, who shall not be entitled to refuse delivery or to claim compensation or damages.
5.5 If it is not possible to deliver the Order to the Customer (due to refusal or failure to accept delivery, or inability to complete delivery after an attempt, e.g. “recipient absent”), the Order will be placed in storage. In order to release the shipment from storage, the Customer must contact Superga to arrange a new delivery and/or provide additional delivery information.
5.6 If the shipment remains in storage, the goods will be returned to Superga at the Central Warehouse located at Strada della Cebrosa 106, Turin 10156. Upon return of the shipment, a refund will be processed in favor of the Customer within 14 working days, using the same payment method selected at the time of the Order, for the full value of the items previously purchased, including any shipping costs, if applied at the time of purchase.
5.7 As an alternative to delivery, where available at the time of purchase, the Customer may choose to collect the Products directly from Superga stores participating in the in-store delivery program, as listed on the Platform. In such case, the arrival of the Products at the selected store will be communicated to the Customer via email, and the Customer will have 10 (ten) days from the date of such communication to collect them by presenting a copy of the shipping confirmation email and a valid ID document. If the Products are not collected within the specified timeframe, the purchase contract shall be automatically terminated and the price will be refunded to the Customer. In any case, payment cannot be made in-store; only online payment methods are accepted.
6. Delivery of the Products
6.1 The Customer is required to promptly check, as soon as possible, that:
a. the number of Products corresponds to what is indicated in the Order and includes all purchased Products;
b. the packaging is intact, not damaged, wet, or otherwise altered, including the sealing materials;
c. the Products include the appropriate labels.
6.2 If any irregularities are found with reference to points a., b., and c. of the preceding article, the Customer, without prejudice to the provisions of Article 8 of the General Conditions, must document everything by means of photographs and promptly inform Superga through the appropriate form made available on the Platform within 10 (ten) days from delivery.
6.3 If the photographs are sent within the timeframe referred to in Article 6.2 and effectively demonstrate deficiencies with respect to points a., b., and c. of Article 6.1, the Customer may initiate the withdrawal and/or return procedure described in Article 7.3 and Superga will proceed with the refund of the price of the Products subject to withdrawal and/or return.
6.4 Failure to submit reports regarding points a., b., and c. of Article 6.1, relating to issues connected with the delivery of the Products, shall result in the forfeiture of the right to claim defects where such defects are a direct consequence of the delivery method of the Products.
7. Right of withdrawal and/or return
7.1 In accordance with applicable law, for any purchase of Products made on the Platform, the Customer has 30 days from receipt of the Product to exercise the withdrawal and/or return, without having to provide any reason and without incurring any costs, except as specified in Article 7.3 regarding shipping costs. Once the online withdrawal and/or return procedure has been completed, the Customer will have 14 days to ship the Products.
7.2 If the Customer does not ship the Products subject to withdrawal and/or return within the timeframe set out in Article 7.1, the Products shall be deemed definitively accepted and it will no longer be possible to proceed with the withdrawal and/or return.
7.3 To exercise the right of withdrawal referred to in Article 7.1 above, The customer may access the dedicated page to submit a return request by using the online withdrawal function available at the following link, by following the procedure and instructions provided on the page.
Following the correct exercise of the right of withdrawal through this function, the system will automatically send the customer an email acknowledging receipt of the withdrawal request and confirming the return authorization.
7.4 In the event of withdrawal, the Customer shall return the Products using one of the following methods, at the Customer’s discretion:
a. shipment of the Product(s) subject to withdrawal and/or return to the address indicated in the withdrawals and returns Form via the courier selected by Superga and indicated therein (this withdrawals and returns method will be at Superga’s expense and will therefore entail no cost for the Customer);
b. shipment of the Product(s) subject to withdrawal and/or return to the address indicated in the withdrawals and/or returns Form via a courier chosen and appointed directly by the Customer (in this case, the Customer shall bear all shipping costs);
c. withdrawal and/or return of the Product(s) subject to withdrawal and/or return to one of the Basic Net group stores located in Italy and listed on the Platform (the Customer must deliver the Product(s) together with the withdrawals and/or returns Form and present a valid identification document).
7.5 The Customer will receive an email confirming the exercise of the right of withdrawal and/or return and will be informed about the status of the return.
7.6 In the event of withdrawal and/or return, the Customer will be reimbursed for all payments made, including the initial delivery costs, except in the case of partial returns of the Order, for which any initial delivery costs will not be refunded.
7.7 The refund to the Customer will take into account only the price actually paid by the Customer at the time of purchase, including any discounts and promotions.
7.8 The refund will be issued within 14 (fourteen) days from confirmation of receipt of the Products subject to a withdrawal and/or return, provided that Superga has received and verified the condition of the Products subject to a withdrawal and/or return. The refund will be made using the same payment method used for the Order. Refund requests using different payment methods will not be accepted.
7.9 If Superga identifies discrepancies in the Products subject to a withdrawal and/or return compared to what was declared, it will inform the Customer by email of the detected reduction in value of the Products subject to a withdrawal and/or return resulting from non-compliance with the aforementioned conditions and will indicate the amount to be deducted from the refund or the denial of a full refund. Alternatively, the Customer may request, at their own expense, the return of the Products in the condition in which they were received by Superga.
8. Product Warranty
8.1 Superga warrants the Products for a period of two years.
8.2 The Customer bears the burden of proving the actual existence of defects of conformity of the Products by providing: (i) images of the non-conforming Product; (ii) a description of the defects found in the non-conforming Product.
8.3 Defects of conformity shall include abrasions, unstitched seams, cuts that do not result from improper or inappropriate use of the Product by the Customer, as well as defects or qualitative and/or aesthetic differences compared to the sample on the basis of which the Product Order was created. Differences relating to colour shades, measurements, proportions, materials and/or other characteristics that are not immediately perceptible or are not significant shall not be considered defects of conformity of the Product.
8.4 Without prejudice to the provisions of Article 135-bis of the Consumer Code, where Superga deems the report referred to above to be well-founded, it will collect the non-conforming Product from the Customer at its own expense and will proceed with a full refund of the non-conforming Product once the actual existence of the reported defects has been verified.
8.5 If, following examination of the non-conforming Product, it is found to be free of the defects reported by the Customer, Superga will return it to the Customer at the Customer’s expense and no refund will be issued.
8.6 Superga shall not be held liable in any way for indirect and/or consequential damages arising from any defects of the Product, and the Customer acknowledges that no liability whatsoever may be attributed to Basic Italia for such damages.
9. Industrial Property Rights
9.1 All Products bear the Trademarks, of which Superga is the owner.
9.2 The Customer acknowledges that all trademarks, names, as well as any distinctive signs, denominations, images, photographs, written or graphic texts used on the Platform or relating to the Products are and shall remain the exclusive property of Superga and the Owner and/or its successors in title, without the Customer acquiring any rights thereto by accessing the Platform and/or purchasing the Products.
9.3 The contents of the Platform may not be reproduced, either in whole or in part, transferred by electronic or conventional means, modified, or used for any purpose whatsoever without the prior written consent of Superga or the Owner.
9.4 The Customer undertakes not to use the Trademarks in any way that may lead the public to believe that there is an economic connection between them and Superga, or in any way that may damage the reputation of the Trademarks.
